Late filing and late payment surcharges in Germany: what being late costs and how to avoid it

If you file a tax return late, you risk a late filing surcharge (Verspätungszuschlag): 0.25 % of the additional payment per month or part of a month, at least €25 per month – automatically after 14 months. If you pay late, every month or part of a month costs a 1 % late payment surcharge (Säumniszuschlag) on the amount rounded down to €50. Interest on back taxes and a coercive fine can come on top. Here is how to calculate it all – and how to avoid it.

All surcharges and interest at a glance

The German Fiscal Code (Abgabenordnung, AO) has several “ancillary tax payments” (steuerliche Nebenleistungen) that are added to the actual tax. They are not deductible as a business expense – not in your EÜR either. It is important to keep them apart: the late filing surcharge and the coercive fine concern filing, the late payment surcharge concerns payment, and interest concerns the time until the assessment.

Late filing surcharge: when it applies

You can find the filing deadlines in the guide tax deadlines for the self-employed: for the 2026 returns it is 2 August 2027, with a tax advisor 29 February 2028. From the day after the deadline, the tax office (Finanzamt) can impose a late filing surcharge; it decides at its discretion and takes into account the duration, frequency and amount of the delay.

Without discretion, i.e. automatically, the surcharge applies if an annual return is not filed within 14 months after the end of the year – for 2025, therefore, after the end of February 2027 (§ 152 Abs. 2 AO). Exceptions to the automatic rule (§ 152 Abs. 3 AO):

  • The tax office has extended the deadline – even retroactively.
  • The tax is assessed at €0 or a negative amount.
  • The tax is no higher than the prepayments and creditable withholding amounts, so there is no additional payment.

Calculating the late filing surcharge: formula and examples

For annual returns the surcharge for each month or part of a month of delay is 0.25 % of the assessed tax minus prepayments and creditable tax deductions, at least €25 per month (§ 152 Abs. 5 AO). It is rounded down to full euros and capped at €25,000. Even with a refund, the tax office can impose a surcharge at its discretion – then at the minimum amount.

The surcharge is calculated separately for each return. If you file your income tax, VAT and trade tax returns late together, three surcharges can therefore arise – each with its own minimum amount. For the annual VAT return the basis is the final payment, i.e. the annual tax minus the amounts due from the advance returns; if you filed all your advance returns, the basis there is usually small and you end up at the minimum amount.

Months or parts of months are counted from the day after the deadline. For the 2025 return (deadline 31 July 2026) this means: filing on 10 November 2026 counts as four months or parts of months (August, September, October, part of November).

Late filing surcharge for the advance VAT return

The 0.25 % formula does not apply to monthly and quarterly advance returns (§ 152 Abs. 8 AO). The tax office decides freely, guided by the duration, frequency and amount of tax due. In practice, a one-off delay of a day often has no consequences; if you regularly file late, you will get surcharges – and risk your permanent deadline extension (Dauerfristverlängerung) being revoked.

There is no grace period for filing: the advance return must be submitted by the 10th (or the next working day). How to prepare it in time is explained in the guide advance VAT return (Umsatzsteuer-Voranmeldung). If no advance return arrives, the tax office may estimate the VAT; the estimated amount must then be paid by the date stated in the notice.

Late payment surcharge: 1 % per month or part of a month

Late payment surcharges arise by law, without a notice and without discretion, as soon as an assessed or declared tax has not been paid after the due date (§ 240 AO). The outstanding amount is rounded down to the nearest full €50, and 1 % per month or part of a month is charged on it. For bank transfers there is a grace period of three days; if it is exceeded, the delay still counts from the day after the due date. No late payment surcharges are charged on surcharges and interest themselves.

This also applies to prepayments and to trade tax collected by the municipality. A SEPA direct debit mandate is the safest protection: the payment is then deemed made on the due date.

Interest on back taxes under § 233a AO

Interest is not a penalty: it compensates for the tax only being assessed late – regardless of whether you filed on time. The interest period begins 15 months after the end of the tax year (for 2025 on 1 April 2027) and ends when the assessment is notified. Since 2019 the rate has been 0.15 % per full month (1.8 % per year); the amount is rounded down to the nearest full €50. It applies to income tax, trade tax and VAT, in both directions.

Example: income tax 2025 with an additional payment of €12,000, assessment notified on 20 July 2027. Full months since 1 April: April, May, June = 3. Interest: €12,000 × 0.15 % × 3 = €54. Tip: if you voluntarily pay the expected additional payment in advance, the tax office takes this into account for interest. Interest on back taxes is not deductible; interest on refunds is taxable as investment income.

Coercive fine and estimation

If you do not respond to reminders, the tax office warns you of a coercive fine (Zwangsgeld, § 332 AO) and imposes it after the deadline expires – up to €25,000 per imposition, often a few hundred euros for the self-employed. Unlike the late filing surcharge, the coercive fine is a means of pressure: if you file the return after it has been imposed but before it has been collected, it is no longer collected (§ 335 AO).

At the same time, the tax office can estimate your tax bases. You lodge an objection against the estimated assessment and submit the return later. An estimated assessment is often the moment when the late filing surcharge, the late payment surcharge and interest all arise at once.

Waiver, objection and payment in instalments

You can lodge an objection (Einspruch) against a late filing surcharge if it was imposed at the tax office’s discretion and the delay was excusable – for example because of illness, a hospital stay or an error by the tax office. The automatic surcharge after 14 months can only be challenged if one of the exceptions applies or the calculation is wrong.

The tax office can waive late payment surcharges on grounds of equity (§ 227 AO): entirely if you always pay on time otherwise and it was a one-off oversight, or if you suddenly became seriously ill; by half if you are insolvent or over-indebted, because then they fail to serve their purpose as a means of pressure. Apply for a deferral (Stundung) or payment in instalments in good time instead of simply not paying: deferral interest (0.5 %) costs only half as much as late payment surcharges (1 %).

Avoiding surcharges: seven rules

Almost all surcharges can be avoided with a routine. For self-employed people liable for VAT, a fixed monthly date for bookkeeping is worthwhile.

  • Enter all tax dates of the year in your calendar and set reminders.
  • Apply for a permanent deadline extension if receipts are regularly cutting it fine.
  • Grant a SEPA direct debit mandate to the tax office and municipality.
  • Apply for a deadline extension before the deadline – not after it.
  • Set aside money for taxes every month, see tax reserves.
  • Have your tax prepayments increased if your profit rises significantly – this reduces later interest.
  • If a payment cannot be made: apply for a deferral or instalments before the due date.

Frequently asked questions

How high is the late filing surcharge for a tax return in Germany?

0.25 % of the assessed tax minus prepayments per month or part of a month, at least €25 per month, at most €25,000. With an additional payment of €5,000 and three months’ delay, that is €75, because the minimum amount applies.

Is there a late filing surcharge if I get a refund?

Not automatically. However, the tax office can impose a surcharge of at least €25 per month at its discretion, especially for long delays.

How is the late payment surcharge calculated?

The outstanding amount is rounded down to the nearest full €50, and 1 % is charged on it for each month or part of a month from the due date. If you pay by bank transfer within three days of the due date, none arises.

When does the late filing surcharge become mandatory?

If the annual return was not filed within 14 months after the end of the tax year – for 2025, therefore, after the end of February 2027 – unless an exception such as a deadline extension applies.

Can I have late payment surcharges waived?

In exceptional cases, yes: entirely for a one-off oversight by an otherwise punctual taxpayer or in the event of sudden serious illness, by half in the case of insolvency. Submit the application in writing with reasons.

Are late filing and late payment surcharges tax-deductible?

No. Both are ancillary tax payments and neither a business expense nor a special expense. The same applies to interest on back taxes.

How high is the interest on tax arrears in Germany?

0.15 % per full month (1.8 % per year), starting 15 months after the end of the tax year. Deferral and suspension interest, on the other hand, is 0.5 % per month.
